In workers’ compensation and personal injury cases, all parties—attorneys, employers, third-party administrators, and liability insurers--have significant responsibilities under the Medicare Secondary Payer Act to protect the interests of the Medicare Trust Fund and insure that medical costs are not shifted to it when resolving a claim that includes future medical expenses. Failure to understand the full impact and requirements of the law results in substantial risks to all parties if Medicare’s interests are not properly considered.

 

I am a Medicare Set-aside Certified Consultant with almost 40 years' experience in settling personal injury and workers’ compensation claims. I have experience representing third-party administrators, lawyers, insurers, self-insured companies, and claimants in which Medicare's interests require consideration. I appreciate that the interests of all parties are often served by the settlement of a claim. With a goal toward helping parties reach their settlement goals, I focus my advocacy-driven practice on Medicare set-aside arrangements and Medicare secondary payer issues.

  • Case review and opinion letter to client as to whether Medicare secondary payer issues need to be considered

  • Contact the Centers for Medicare & Medicaid Services (CMS) to determine Medicare’s reimbursement claim and to resolve disputes over inclusion/exclusion of specific medical/pharmaceutical charges

  • Case analysis to determine a recommended Medicare Set-aside (MSA) amount for purposes of settlement evaluation and negotiation

  • Full MSA evaluation and submission including resolving the Medicare reimbursement claim, and preparing and submitting the MSA to CMS

  • Preparation of settlement documents, including documents for either a self-administered MSA trust or professionally administered MSA trust

  • Consultation on MSA administration issues
